James Madison once asked "Is there no virtue among us? If there be not, we are in a wretched situation. No theoretical checks, no form of government, can render us secure."
The Supreme Court now worries whether the threat of prosecution could deter a president from discharging his duties. They are right to worry. The president must have as much latitude as possible to act in the nation's best interest. The trouble begins when he does not have the nation's interest at heart. This President Trump did not have.
The court now faces a choice between a less effective presidency and a tyrannical one. One of the two is clearly the lesser evil. Clearer still is the damage done by Donald Trump to the presidency.
